The form most commonly used by employers is the Employment Eligibility Verification
Form, I-9. For information about the I-9 visit http://www.uscis.gov/files/nativedocuments/m-274.pdf.
To download the form,
visit
http://www.uscis.gov/files/form/i-9.pdf
All employees must complete an I-9 during their first day of
employment. Employers have until the end of the third day of
employment to complete their portion of the form. The forms are kept in
the company's personnel files; they are not mailed. It is extremely
important that you have a completed I-9 for every employee. If an inspector comes to your office and
you do not have the forms on file, you could be fined for each missing
form.
It is important to note that Sole Proprietors and
Partners are required to maintain a completed Form I-9 for themselves in their
files, as well as maintaining forms for their employees. For more
information about employee issues, visit the Employer
Issues section of this Web site.
